Appeals Court Sides With Oneida Co. Judge On OWI Case

en.wikipedia.org

A northern Wisconsin prosecutor was wrong to reduce a drunk driving charge in a plea deal, without a judge approving it beforehand.

The Third District Court of Appeals ruled Tuesday in favor of Oneida County Circuit Judge Michael Bloom, who rejected the plea deal for Brian Corvino. Both sides in the case had agreed to reduce Corvino's 2014 felony charge of four time O-W-I to a misdemeanor -- but Bloom said the law required him to approve any changes in drunk driving charges once they're filed, and he said the proposed reduction would not serve the public interest so he ordered that the felony charge be restored.

Corvino challenged the decision, and the appellate judges in Wausau agreed with Judge Bloom's action. The 44 year old Corvino lives in Madison.
