Family Attempts Another Federal Appeal Of Oneida County Case

A family that has tried for more a decade to build a religious camp and conference center on Squash Lake in Oneida county is making another attempt in federal court.

The Jaros family first tried to open Eagle Cove Camp and Conference Center on family land in 2004. In 2010, they began a federal pursuit to have those courts overturn the town of Woodboro, Oneida county and the Board of Adjustment's denials of needed permits. Their federal case alleged the denial of their religious rights.

In May of 2014 the U.S. Supreme Court failed to take the case after lower federal courts ruled the county did not make errors in denying the permit.

The plaintiffs filed an appeal to reopen the case on the basis that the U.S. Court of Appeals in Chicago said it had ruled incorrectly in 2013 on a key part of Eagle Cove's case and that key component from the 2013 rulings was no longer valid. The appeal was filed in U.S. District Court in Madison. A federal judge there denied the motion for appeal on August 11 this year, and the family now has filed a motion of appeal with the U.S. Court of Appeals for the Seventh Circuit located in Chicago.

A state court case filed in Oneida county is on hold until the outcome of the federal appeals are finalized.
