A recent federal court development could reopen the possibility of a federal court review of a long running case arising in Oneida county.
An attempt by the Jaros family to have federal courts overturn local zoning decisions decided by Oneida county, its Board of Adjustment, and the town of Woodboro ended last year when the U.S. Supreme Court decided not to hear the case. A part of that case was refiled in Wisconsin's state court system and remains pending in Oneida County's Circuit Court.
The family hopes to build Eagle Cove Camp and Conference Center on family-owned land on Squash lake west of Rhinelander. The needed permits were denied and the family took the matter to U.S. District Court in Madison and the U.S. 7th Circuit Court of Appeals where their arguments were denied.
Now a new development: the 7th Circuit U.S. Court of Appeals in Chicago has ruled in a prisoner's religious liberties case also originating with Judge William Conley in Madison that the 7th Circuit had decided a key part of Eagle Cove case contrary to more recent rulings of the U.S. Supreme Court. A source says since a portion of the Eagle Cove case has been overruled, a motion has been filed asking Judge Conley to reopen that part of the federal case.
