Daley Says He Would End 'Activism' On State Supreme Court

A long time Rock County judge says he would end what he calls 'judicial activism' if he is elected to the State Supreme Court April 7.

Judge James Daley is running against Judge Ann Walsh-Bradley who is running for a third ten-year term.

Daley has a long history in both the legal profession and the military. He served as a trial lawyer until he was elected to the Rock County District Attorney's office in 1985. He was appointed by Governor Tommy Thompson as a Circuit Court Judge in 1989. He's been reelected 5 times. A Viet Nam veteran, he also retired from the Army National Guard as a Brigadier General.

Daley says he doesn't believe in making law from the bench....

"...I think voters should evaluate potential judges based on our legal ability and our commitment to interpreting the law without bias or prejudice. My opponent has not demonstrated the characteristic to be without bias or prejudice...."

Judge Daley says state Supreme Court rulings have left key sectors with uncertainty, namely law enforcement and business...

"....uncertainty is not good for maintaining jobs in this state and uncertainty is not good when you keep changing the rules in law enforcement either. I really think the role of the Justice is to insure that in fact that we uphold the Constitution and rule of law and remove as much uncertainty as we can...."

He says he favors a Constitutional Amendment before voters in April which would allow the state Supreme Court Justices to name the Chief Justice, as opposed to having that position picked by seniority.
